I'm not a charter captain nor do I quite understand all of this. With that being said I think it has got to the point where it needs to stop. We all need to stand up and say enough is enough. Rules on top of rules limits out the ass. I'm tired of it and can't believe I'm alone.

For-Hire Permit Limited Entry Options Paper

At the June 2016 Council meeting, staff were directed to bring an options paper to the September 2016 meeting describing how the Council might go about establishing a limited entry system for the Coastal Migratory Pelagics, Snapper Grouper, and Dolphin Wahoo for-hire permits.

The SAFMC has considered limited entry permits in the past in the king mackerel and snapper grouper fisheries. Below are the relevant preferred actions/alternatives from past plan amendments that established limited entry permits.

King Mackerel Limited Entry Permit (CMP Amendment 15 - 2004)
• Establish a limited access system for the commercial fishery for Gulf and Atlantic group king mackerel. A commercial king mackerel limited access permit will replace the existing commercial king mackerel permit, and a separate Gulf gill-net permit will replace the current gill-net endorsement in the Gulf. All vessels with valid permits and/or endorsements on the date that this amendment is approved will be issued such permits, and they will be renewable and transferable in the same manner as currently prescribed for general permits and gill-net endorsements in the Gulf, respectively.

Gulf of Mexico for-hire limited access permits (CMP Amendment 17 - 2006)
• Establish a limited access system on for-hire reef fish and CMP permits. Permits will be renewable and transferable in the same manner as currently prescribed for such permits. The Council will have periodic reviews at least every 10 years on the effectiveness of the limited access system.

In the Gulf of Mexico For-Hire Vessel Permit Moratorium Amendment (CMP Amendment 14 – 2001) the following actions (among others) were put into effect:
• Created a new for-hire permit with endorsements for reef fish and coastal migratory pelagic species. It required that permitted vessels have a vessel decal and that all permits and/or endorsements be permanently numbered to track them through history.
• Allowed for permits/endorsements to be fully transferable with or without the vessel, but without any increase in passenger capacity.
• Established a “permanently revoked” provision in that permits not renewed within one year of their expiration would not be reissued.
• Established an appeals process that allowed individuals or corporations to appeal to the regional administrator to resolve issues related to the NMFS permit office records that pertain to initial eligibility.

Snapper Grouper Amendment 8 (1997) established a commercial limited entry permit for the snapper grouper permit. The following are actions that were put into effect for that permit:
• Permits were limited to those who could demonstrate they any landings of species in the FMU in at least one year from 1/1/1993 through 8/20/1996.
• The also had to have had a valid snapper grouper permit at any point from 2/11/1996 through 2/11/1997.
• Any vessel that landed at least 1,000 lbs of snapper grouper species in any one year between 1/1/1993 and 8/20/1996 received a transferable permit.
• Any vessel that met the criteria, but did not land at least 1,000 lbs of snapper grouper species in any one year between 1/1/1993 and 8/20/1996 received a non-transferable permit and were limited to 225 lbs maximum of snapper grouper species on any one trip.

Based on these prior actions, the following are criteria the Council may want to consider in converting the for-hire mackerel, snapper grouper, and dolphin wahoo open access permits into limited entry permit.

• Will new permits be created?
• What are the criteria for getting a limited entry permit?
⇒ How many years did a vessel have to have an open access permit
⇒ What years did a vessel need to have an open access permit
⇒ Landings criteria
• Will there be permits that will not be transferable (e.g. SG 225 lbs permit)?
• Will limited entry permits be transferable?
⇒ Can the number of allowable passengers be modified when a permit is transfered
• Will there be any endorsements tied to the limited entry permits?
• Will vessels be required to have any identifying decals or other markings?
• Will permits be permanently revoked if they are not renewed?
• Will an appeals process be set up for those who are not selected for a permit initially?

The Committee will need to give direction to staff as to how to proceed with the development of this amendment. For example, staff could develop a draft document for Committee review at the December 2016 Council meeting that could be revised and taken out for scoping in early 2017.

I hope everyone is doing well.

We ask the council to reconsider pursuing limited entry for the for-hire sector.

The truest test of support for for-hire limited entry is the stakeholder input the council received on the snapper-grouper Vision Plan.

After three years, 26 port meetings and the input from 362 fishery stakeholders, only one comment (Stuart, FL: “Concern about effort in the for-hire sector”) can be identified that is specific to any support for for-hire limited entry.

I urge you to carefully review the Vision Plan public input summaries for each state from the September 2015 council meeting briefing book (Attachments 3-6):

As most recreational and commercial snapper-grouper fishermen in the South Atlantic also participate in the coastal pelagic and dolphin-wahoo fisheries, I believe the overwhelming lack of support for for-hire limited entry from snapper-grouper stakeholders in the Vision Plan is indicative of the lack of support in the coastal pelagic and dolphin-wahoo fisheries.

After the most comprehensive effort ever by the SAFMC to seek stakeholder input into how a fishery should be managed, it’s crystal clear that stakeholders don’t view for-hire effort as a problem at all. Council should listen to these stakeholders as promised.

As you are well aware, the council has a very full plate, including implementation of the Vision Plan. It doesn’t seem wise to add to that plate and the staff’s workload a fishery plan amendment that is documented to have virtually no support among fishery stakeholders and for which there is no documented biological reason for implementation.

Again, we ask that the council not pursue for-hire limited entry. Thanks for your consideration.

If you are a Charter boat captain you really want to be at this meet...

The SAFMC has set a control date of June 15th 2016 to be able to get into the For-hire Limited Entry, This means if you do not have a For-Hire for South Atlantic Dolphin Wahoo, Snapper Grouper, and Coastal Migratory Pelagic fisheries. That when this goes in effect you will not be able to get one with out buying someone out or if you want to at a boat to you fleet you will not be able too....

Also the SAFMC is back on the Catch Shares too. With a experimental fishing permit aka Catch Shares permit for only a few. Please ask the Council members not to this and to do way with Catch Share committee

What this means if this passes is that if you did not hold a Charter Atlantic Dolphin and Wahoo, Atlantic Coastal Migratory Pelagics, and South Atlantic Snapper-Grouper permit as of June 15, 2016 you may not be able to charter fish for Dolphin and Wahoo, Migratory Pelagics, and Snapper-Grouper on charters or will not be able to add more boats to your charter business or will not be able to get in to the charter fishing business.

There is a 30-day comment period. IF you do not want this to pass you need to make comments...

Control Date for the Federal For-Hire Recreational Sector of Fisheries for the Atlantic Dolphin and Wahoo, Atlantic Coastal Migratory Pelagics, and South Atlantic Snapper-Grouper


On September 27, 2016, NOAA Fisheries published an advanced notice of proposed rulemaking to set a control date of June 15, 2016, for the federal charter vessel/headboat (for-hire) component of the recreational sectors of the coastal migratory pelagics fishery in the Atlantic, dolphin and wahoo fishery in the Atlantic, and snapper-grouper fishery in the South Atlantic. This notice informs current and potential future fishermen that the South Atlantic Fishery Management Council (Council) is considering restrictions limiting participation in these fisheries. Fishermen who enter the federal for-hire recreational sector for these fisheries after June 15, 2016, will not be assured of future access should a management regime that limits participation in the sector be prepared and implemented.

The establishment of a control date does not commit the Council or NOAA Fisheries to any particular management regime. The Council may or may not make use of this control date as part of the requirements for participation in these fisheries. Fishermen are not guaranteed future participation in the sector, regardless of their entry date. The Council may take action that would affect participants who were in these fisheries prior to the control date, or the Council may choose to take no further action to control entry or access.

When they separate out the "for hire" sector, where do you think their quota is going to come from?

It is going to come from the recreational side!

Think 3 pinkies or 5 vermillions now is bad? Wait until more than half of it is allocated to the for hire sector. How are they going to divide up our 1 gag? By extending the amount of time the grouper are closed of course.

Do you still think that just saying no will stop the push to privatize our fisheries?
Do you think closures and regulatory discards are a problem now that they impact your fishery?
Do you think enhancing our fisheries and food supply is a better option than restricting the public's freedom to access them?
