Bald Head's public safety now has the power to enforce the general statute designating all the waters within Bald Head as a no wake zone. The GS has been on the books since '87 but left up the Brunswick Co. deputies and wildlife officers to enforce. The village now has a boat at the marina and has hired extra help for enforcement. Below is the announcement by the village.

NO-WAKE SPEED ZONE UPON THE WATERS WITHIN THE JURISDICTION OF THE VILLAGE OF BHI (HB 1027 & SESSION LAW 2018-20): Staff provided an update on the recent passing of HB 1027 (Session Law 2018-20) this past short session of the General Assembly. The recent passing of legislation is specific to the No-Wake zone and enforcement throughout Bald Head Creek by the Village Public Safety Department. The Village would like to recognize the efforts on the part of the local delegation including Representative Frank Iler, Senator Bill Rabon, and their respective staff for getting this local bill passed. Click here to see a copy of the recently approved bill, Village Councilís resolution passed back in February 2018, and existing legislation passed in 1987.

While I truly appreciate their efforts and I am not one to wake any area unnecessarily and abide by all legal no wake zones...they are going to have one hell of a time enforcing the GS. They have no authority to write citations or pull boats over. The analogy would be me standing on my street trying to pull over cars for speeding through my neighborhood. This is a set up for a bad scenario unfolding where a civilian entity tries to enforce a law they have no authority to do. At the end of the day they can only warn or take photos/video and turn over to appropriate authority. ULTIMATELY no matter where you are rolling through you are responsible for your wake!!!

It appears to me that they might have authority according to the house bill in the link below but I'm not a lawyer nor a LEO.

I think it was three years ago that a charter guide pulled up to me and stated that he couldn't be expected to take his charters this far into the creek at idle speed at their expense. We were roughly in the lower third of BHI Creek. I shouldn't have been surprised given the "entitlement" attitude that is prevalent in society today, but it's been a burr under the saddle ever since he uttered it. This occurred after he was pulled over by BHI public safety and given a warning for making wake. I haven't seen him in the past few weeks but earlier he was still not in compliance.
While I'm opposed to a great deal of the proposals/regs put forth by the village such as beach re-nourishment, jetties, (fighting losing battles with mother nature by tax assessment), and building a new fire department building with more space dedicated to people than to fire equipment, (a real head scratcher there), I'm in agreement on enforcing the no wake rule.

The no wake zone is in place to protect the kayak and SUP rentals. There are very few docks and almost no boats back there

They should just create a 100 yard no wake zone around the dock. Only small boats are back there anyway since the entrance is so shallow. No real big wakes it has to be more of a speed concern with all the tourists
