2006 OYSTER SEASON FOR MECHANICAL METHODS

Preston P. Pate, Jr., Director, Division of Marine Fisheries, hereby announces the following change in the oyster harvest season for mechanical methods effective at sunset, Tuesday, January 31, 2006:

I. AREA CLOSURE
The oyster harvest season for mechanical methods WILL CLOSE in public bottom areas where it is presently allowed south of the 35° 35.0000’N latitude line.

Oyster harvest by mechanical methods will continue to be allowed north of the 35° 35.0000’N latitude line until closed by proclamation at a later date.

II. GENERAL INFORMATION:

A. This proclamation is issued under the authority of G.S. 113-170.4; 113-170.5; 113-182; 113-183; 113-221.1; 143B-289.52; and N.C. Marine Fisheries Rules 15A NCAC 3H .0103, 3K .0201, 3K .0202, and 3K .0205.

B. It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to NC Marine Fisheries Rule 15A NCAC 3H .0103.

C. Oysters marketed from private beds must be accompanied by a certification form as required by N. C. Marine Fisheries Rule 15A NCAC 3K .0205.

D. This action is being taken because the majority of legal size oysters in southern Pamlico Sound and its tributaries have been harvested. Harvestable oysters are still present in parts of northern Pamlico Sound. The 35° 35.0000’N latitude line runs from the vicinity of Long Shoal Point easterly to a point on Hatteras Island just south of Rodanthe.

E. This proclamation supersedes SF-13-2005 (REVISED), dated December 20, 2005.
