It was not until the first half of December that a multiplayer empire-building game, Myth of Empires, was made unavailable on Steam after the makers of ARK: Survival Evolved claimed that Myth was made using the stolen source code of their game. Mythet’s Chinese development team, Angela Game, apparently didn’t like the development, so they filed a lawsuit denying the allegations and hoping to lift Steam’s ban. But this week, the publisher and developer of ARK, Snail Games and Studio Wildcard, submitted a document explaining in more detail why they see it as a theft. And based on their arguments, it really does seem like Angela Game has blown the source code.
Angela Game's lawsuit alleges that Snail Games' evidence of theft is misleading and incomplete, and that the same names (character classes, features, and more) in the two games are not subject to ownership regulations anyway. According to the studio, removing Myth of Empires from Steam will cause and could cause irreparable damage to them in the future.
However, Snail Games and Studio Wildcard continue to claim that this is a "brazen theft" of their intellectual property and that Angela Game is not entitled to any exemption. According to them, Yang Li Ping, a former employee of Snail Games, requested access to the ARK source code back in 2018 "for seemingly legitimate reasons," which he then received. He is accused of secretly copying the code and then started working for Angela Game a few months later. The announcement also noted that of the 82 people who gave their names to Myt, 60 worked at Snail Games in the past.
Jeremy Stieglitz, head of Snail Games ’U.S. division, said the first similarity between the two games was noticed in the EXE file that was obtained from Steam for Myth. According to him, the initial similarities were "shocking" and hundreds have been found since then. The document also says Bastian Suter, CEO of BattlEye's anti-fraud system maker, said he had "immediately" convincing evidence that Myth was using ARK's copied source code, regardless of the makers of ARK. According to him, the Myth EXE file contains a number of unique strings that are used by BattlEye's integration code and can also be found in ARK, in some places even spelling errors are the same (for example, recieve instead of receive).
Snail Games and Studio Wildcard require that all versions and documentation of the Myth of Empires source code be maintained and recommend that a third party compare them to the ARK source code.
